What is a covenant?
A covenant is a private agreement between a developer and a land buyer that establishes design and construction standards to create a thriving community.
Unlike government-enforced zoning laws, covenants are enforced by the landowners. They typically restrict:
Density: Limiting development to one house per lot.
Size: Setting minimum or maximum dwelling sizes.
Aesthetics: Dictating building materials, facade styles, and finishes.
Landscaping: Outlining requirements for gardens and fencing.

Why have covenants?
Nearly all newly developed residential land for sale will have some form of covenant over them. Developers create covenants to influence how the land is used, even after it is sold.
This enables effective parameters to the standard and quality of building in a subdivision, preserving the value of any remaining lots. People can with confidence, buy into an estate and know the level of housing around them will be similar to that of the house they are designing.
Moreover, many purchasers like to see this sort of regulation as it enhances and protects the asset they are buying by ensuring that nothing undesirable is built in the neighbourhood.
It’s important buyers become familiar with the covenants. Always discuss the covenants with your builder when designing your home.

How to ensure your design will get Covenant Approval?
When you come in to discuss purchasing land in our estates, we will guide you through the key points that will apply to the block of land you are interested in. A copy of building information documents per Stage release are copied below and available for download.
We work closely with most of Townsville’s leading builders and will pass on a copy of the covenants and building information documents (below) to your builder, so that they are aware at the beginning what is required.
Once a concept has been drawn our Covenants Team can assess it against our covenants and give any feedback before you commit to a purchase.
Remember that your home must receive full covenant approval (design, landscaping and colours) before your builder can commence building. A copy of the covenants will form part of your signed land contract.
